Custer versus Summer Breeze Update

I am talking on the phone with Summer Breeze (Cheryl Gardner) right now. She is at Marquette calling from a law office. Today she had another arraignment at Marquette, Michigan for the "gathering without apermit citation."

The pre-trial conference is set for May 12th 2004. All motions must be filed by April 9th. The government reserves two weeks to respond to alldefense motions. It was entered into the record that in fact the FBI is investigating allegations against John Hunt. The court has been made aware that Cheryl Gardner could eventually be sequestered as a material witness in the FBI investigation. It was John Hunt that had Cheryl Gardner arrested by Forest Service LEO, Carmen Kinch. Even though John Hunt was harassing and intimidating a witness against him, Carmen Kinch
allowed John Hunt to "supervise" the arrest of Cheryl Gardner.

There is going to be a regional spring council near Michigan with the Great Lakes Family from about May 7th up to a few days before Summer's pre-trial conference. May 7 - 9, 2004, is the date for Michigan Spring Council as per the posting at: http://www.greatlakesrainbow.info/

Summer Breeze was asked to sign a paper stating she has a right to a trial before a Magistrate. Signing such a paper would mean that a Magistrate would decide the verdict with no jury present. Summer refused to sign and stands under her right to a trial by a jury of her peers.

Special Notice: Refusal to sign the "permission" for a Magistrate Judge, in this particular instance Judge Greeley, removes this judge's ability to continue on the case. According to the Rules of Federal Criminal Procedure, the Magistrate Judge who does not obtain permission to preside over a case by the "Defendent" is then duty-bound to move the case to a court presided by an Article III Judge.
