Custer versus Summer Breeze

Yesterday, Summer Breeze left Mount Shasta for Sacramento. She was on her way to appear at a 2 PM arraignment before the Honorable Judge Hollows.

Before Summer left Mount Shasta, I spoke to her at length. She told me what the facts of her case were and I took note. Here is a summary of what she told me yesterday and today.

Summer spoke to her counsel, Brian Michaels, Esquire at Eugene,
Oregon. Brian worked out a deal with the prosecuting District
Attorney. They agreed to drop all the criminal charges if Summer
would just plead guilty to the "peaceable assembly without a permit" citation and pay a fine. Brian contacted Sung Lee, a legal defender at Sacramento, and clarified the deal with him. Sung Lee stood in for Brian as counsel for Summer since Brian could not be there for the arraignment.

It was a cut and dry deal--cop a plea to the ticket, pay a fine, and go home, no more charges, no more court. But the District Attorney had other intentions and violated the deal without giving any notice. She tried to "blindside" and ambuscade Summer in court.

The District Attorney demanded other criminal sanctions against
Cheryl Gardner that were not part of the deal, including extradition to Michigan to serve a prison sentence for charges that have not even gone to trial. Summer was ready to plead to the ticket when the prosecutor broke the deal and then claimed she was not privy to any prior arrangements of a deal. I am investigating to find what judicial misconduct rules the prosecutor's actions fall under. Using deception to coerce and trick a woman into pleading to charges that are not even on the table is unthinkable. Judge Hollows continued the proceeding to look further into the matter. He stated he was not comfortable with the case as it stands.

-x- No Plea

Summer told the Judge that she cannot move forward in the matter or enter a plea until she knows what she is pleading to. It is still unclear what the government is charging her with. They appear to be keeping it a secret so they can try, convict, and sentence her under confusion and duress without a trial, without due process. A three-year prison term was mentioned.

Summer has not yet entered a plea and does not intend to do so until all facts of the charges are laid on the table and made perfectly clear.

I am wondering what happened to the plea bargain and why the
prosecutor denied any knowledge of it to the Judge. If it can be
shown who lied to whom, someone in the judiciary should be facing
criminal charges and/or disciplinary action. It appears the
prosecutor deceived both Brian Michaels and Summer Breeze.

The arraignment is continued until next Wednesday.

-x- Videos

Several parties have video recordings of Summer Breeze presenting
herself to Malcolm Jowers at the Utah Gathering. During this
incident, Summer asked Malcolm if he had a warrant for her arrest and if he would like to serve the warrant and take her into custody at that time. Malcolm declined.

For all who have said videos. Please safeguard them carefully. Please make several copies of each and distribute them to trusted people who will hold them secure. Please copy them yourselves--do not hand them over to any officials or attorneys to be copied, as they
might "disappear." There are already deceptive tricks being played by officers of the state and court.

Remember, keep the videos safe. They are the main evidence that shows the maliciousness and vindictiveness of the prosecution. I reiterate, it is important that you make copies of the videos and put copies with people that will keep them safe.
