OCCUPANCY AND USE
Pursuant to 36 CFR 261.50(a) and (b), and to protect public safety and natural resources, the following acts are prohibited in the South Warner Mountain Closure Area within the Warner Mountain Ranger District of the Modoc National Forest. The South Warner Mountain Closure Area is described on Exhibit A and shown on Exhibit B. This order is effective from June17, 2004, through August 1, 2004.
1.Camping within 150 feet of any running stream or body of
water.
36 CFR 261.58(e).
2. Being publicly nude. 36 CFR 261.58(j).
3. Possessing a dog not on a leash or otherwise confined. 36 CFR 261.58(s).
4. Placing kitchen facilities, food preparation areas, gray water pits, or slit trenches within 300 feet of any running stream or body of water. 36 CFR 261.53(e).
5. Parking or leaving a vehicle in violation of posted instructions. 36 CFR 261.58(g).
6. Possessing an alcoholic beverage in violation of California law. 36 CFR 261.58(bb).
Pursuant to 36 CFR 261.50(e), the following persons are exempt from this order:
1. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
2. Persons with a permit from the Forest Service specifically authorizing the otherwise prohibited act or omission.
These prohibitions are in addition to the general prohibitions in 36 CFR Part 261, Subpart A.

A violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than six months, or both. 16 USC 551 and 18 USC 3559, 3571, and 3581.
