Summer Breeze response to Utah Attorney General's Office

Correspondence between Cheryl Gardner, a/k/a Summer Breeze and Paul Murphy, aide to the Attorney General in Utah.

Let it be known that one of Paul Murphy's press agents interviewed Summer Breeze at the Utah Gathering in 2003 and sent greetings to Paul Murphy for Summer Breeze. Paul and Summer met during another national case in the media in 1998.

Dear Paul,
I am sending a press release put out by an acquaintance of mine.
It is very accurate and includes most all the current information.

Of course, there is much to say about the gathering in Michigan
two years ago and the events that led up to my arrest in recent
weeks. I am so weary with filing reports, questionaires and affadavits. I will fill in the blanks if you will ask me some questions, or I will just compile more of the "Michigan ticket" information and highlights from "Custer v. Summmer Breeze" in Utah 2003.

Take the time to read this press release while I compile a more
detailed list tomorrow. Police are pressing charges for me against John Hunt for harassing a witness. This has finally come about after much insistance and repeated phone calls, visits and report filing to the Mount Shasta Police Department for three months. It has been hectic and unreal.

Let me know what further details you might need. Much supportive
documentation and testimony exists...in fact, volumes.

My attorneys both repeated the rumored comment that authorities
with the Forest Service believe that I am a "rainbow leader", but we have none of those.

Rainbow Family "Leader" arraigned in Federal Court in Sacramento

Gardner is also a witness in California State court cases against
John Hunt of Mount Shasta. United States DA attempted to secrete
Gardner out of jurisdiction of California courts without briefing
Judge Hollows. Judge reprimands several officers of the court for
failure to brief him, warned it might amount to witness tampering.

_o. Cheryl Gardner's van broke down at Mount Shasta, California.
She contacted the Saint Vincent dePaul society for assistance. They
sent her to the Coffee Connection which put her in touch with John
Hunt, dba Friar Tuck's Sanctuary at Mount Shasta, California.


_o. John Hunt asked Cheryl to work with him in the capacity of an
administrative assistant, and as a minister to help him set up a
"Free Sanctuary" to assist people in life's transitions.


_o. John Hunt was under investigation for unlawful labor practices.
The California Labor Commissioner John McBride filed an action against
Hunt. Cheryl Gardner witnessed in Hunt's behalf because she was
convinced that the agency was putting too much pressure on Hunt.
She got the administrative court to drop Hunt's fines from $4000 to $1000.


_o. Then events took a turn for the worse. Hunt filed an appeal.
The Labor Commission made demands that John Hunt get Workman's Compensation
Insurance and straighten out his payroll and employee reporting
procedures. Until this could be done, he was to remain on a stop
work order [15 September 2003] and have no employees. Hunt violated
this order and continued to coerce employees to work for him without
pay for several months. Hunt coached his employees to lie to the
Labor Commission if asked whether or not they work for John Hunt.


_o. Gardner claims that Hunt sexually harassed her and other women
at the sanctuary. Some other women confided in Gardner that Hunt was harassing them.


_o. Hunt demanded Gardner to assist him in sorting and destroying
files that were under subpoena by the Labor Commission. He was given
a deadline to turn in the evidence and demanded that Gardner help
him figure out what incriminating items to secrete and destroy.


_o. Gardner refused and turned over copies of all files evidence
to the Labor Commission. She returned the originals to John Hunt
under police escort. The next day John Hunt appeared at the Labor
Commission hearing in Redding and stated he had no such files.


_o. Then John Hunt began a campaign of stalking, harassment, and
threat against Cheryl Gardner and her family. His course of action
indicates he was attempting to silence her so she could not testify
against him in upcoming court actions.


_o. The Mount Shasta Herald printed an article on the front page
on Wednesday, January 14th. Later that day, John Hunt brought a
Forest Service officer to the house of Cheryl Gardner after local
police warned Hunt to stay away from Cheryl. The Forest Service
officer arrested Cheryl on a failure to appear for a ticket she
got for praying in the forest at a Rainbow Gathering in Michigan
without a permit to assemble and pray.


_o. The next day while Gardner was on her way back to Mount Shasta
from Sacramento, Hunt entered her house and removed her furniture
and possessions. He had no eviction order and had not even litigated
eviction in a court of law. Gardner is seeking to press charges.


_o. Federal Judge Hollows was disturbed by the actions of the US
District attorney. They failed to brief the Judge that Cheryl is
a material and crucial witness in pending Labor Commission and criminal cases against John Hunt.


_o. According to a series of posts at the Usenet newsgroup alt.gathering.rainbow,
Hunt has harassed, stalked, and intimidated Cheryl Gardner and openly
interfered with a witness against him.


_o. Gardner's arraignment on the citation is continued until next Wednesday.


_o. The US District Attorney wants to extradite a witness outside
of the jurisdiction. The DA accused Gardner on the record of littering
the forest with a bunch of junk vehicles. The Judge asked if anyone
there saw Cheryl Gardner do this. He stated that the only issue
is failure to appear, and by his opinion, Gardner did not fail to appear.


_o. Judge Hollows put up a $10,000 unsecured bond for Gardner’s
release. He said she was being released according to the Bail Reform Act of 1984.


_o. In Utah at the 2003 annual Rainbow Gathering, Cheryl Gardner
presented herself to Incident Commander of the Forest Service, Malcolm
Jowers. She asked Malcolm if he would like to serve a warrant and
take her into custody. He declined. Several people video taped this
incident. At that incident, Cheryl was also interviewed by an outdoor
magazine writer from Park City, Utah.


_o. The DA demanded a mandatory prison sentence in a Federal Prison,
yet Gardner has been convicted of no charge. The judge chastised
the DA for suggesting such a thing. He opined, "Why don't we just
make it a law that anyone charged with a misdemeanor with a $100
dollar or less collateral fine receive an automatic sentence of
30 days, whether they are guilty or not. What say you?"


_o. An advisor to Cheryl Gardner's counsel stated that the DA believes
Cheryl Gardner is a Rainbow Leader and must be stopped.


_o. Evidence posted on the Internet indicates that John Hunt used
connections in the government to have Cheryl Gardner arrested and
extradited so she could not testify against him.


_o. It is rumored that the annual Rainbow Gathering will be at Northern California in 2004.


_o. Cheryl Gardner has operated a ministry for several years, Angels
of the Light Interfaith Ministry.
