Hi Karl,

Just a reminder... please eMail your Reply Brief in Badjer's
defense, as we discussed. I obtained the "Government's Post-Trial Brief" from the Court Clerk, which is deviously short -- simply
asserting the 3 'elements' of the criminal offense and citing the
defendant's pre-trial stipulation -- as if there were no
constitutional issues at all.
One concern: I hope it was not "agreed by the parties on the record" that these 3 elements constitute an individual crime based on the non-performance of other parties unknown to the defendant. That is a flaw this case should attack.

Another brief query: What is the status of Cheryl Gardner's case... are you representing her, is she set for trial, has discovery commenced, and what pre-trial briefing is to be done?Of course I have further casedocs that can help. Notable among them might be the "U.S. v Masel" ruling, which suggests "theoretically" that anyone might be subject to citation under the Group Use scheme as written -- upon which LEO's now assert the broadest discretions to cite gatherers en masse, or to target certain people pretextually as a result of otherwise lawful activities.

Cheryl's ticket falls into the latter category, where it resulted
from efforts to observe LEO actions and inquire about others being arrested and cited.

Further research is worth talking about, still catching up
from my return a few days ago. Let's put it all together...
